Scope

These terms and conditions apply to the generally binding accommodation contract for the rental of accommodation (rooms and holiday apartments, etc. hereinafter referred to as “accommodation”) as well as to all other services offered between Urlaub-Altmark.de - BB Produktions & Handels GmbH & Co. KG, Bismarker Street 15a. - 39628 Bismark OT Kläden - Telephone: 039324 - 929796 - info@urlaub-altmark.de (hereinafter referred to as "Pension") and its guests (hereinafter referred to as "guest"). A unilateral change in use of the services offered is not permitted or requires written consent.

Conclusion of contract
  1. If accommodation is ordered and confirmed or made available in the case of short-term bookings, an accommodation contract has been concluded. A legally binding conclusion of contract also applies to verbal bookings, particularly those made by telephone, unless the written form has been expressly agreed.
  2. The conclusion of the accommodation contract obliges both contracting parties to fulfill the contract, regardless of the duration of the contract. The pension is obliged to provide the booked accommodation for the agreed period. The guest has to pay the accommodation price as contractually agreed. The fee for the accommodation and all services received by the guest are usually paid in advance or are due for payment on the day of the guest's arrival and must then be paid in cash.
  3. The prices given by the pension are final prices and include the statutory value added tax and all additional costs, unless otherwise stated. In addition, there may be surcharges and fees for services to be billed based on consumption (electricity, water, gas, wallbox charging current, etc.) and for optional and additional services.
  4. The guest undertakes to observe the house rules.
Delivery and return of accommodation

The booked accommodation is available to the guest from 4 p.m. on the agreed day of arrival.

On the agreed day of departure, the accommodation must be vacated and made available no later than 10:00 a.m. Different agreements can be made between the pension and the guest.

Resignation
  1. A unilateral withdrawal from a binding booking by the guest free of charge is generally excluded if the guest cannot use the booked accommodation for reasons that lie within their sphere of risk (exception: force majeure).
  2. If the guest nevertheless withdraws from the contract, the guesthouse will charge the following cancellation fees:
    from 4 weeks before the start of the contract 10% of the agreed price;
    from 2 weeks before the start of the contract 50% of the agreed price;
    80% of the agreed price from 1 week before the start of the contract;
    If you do not show up without notification, 100% of the agreed price.
    The agreed price corresponds to the total price listed in the electronic reservation confirmation. The cancellation fees are due upon receipt of the cancellation.
  3. The guesthouse is held in good faith to rent out unused accommodation to someone else and must offset the fee against the cancellation fee it has asserted.
  4. The guest reserves the right to prove that the pension has suffered no or significantly less damage.
Corona / Pandemic

Should the federal government or the state of Saxony-Anhalt impose a ban on overnight stays for shops, you are welcome to cancel or rebook free of charge! However, if you arrive from a risk area or you have ordered quarantine, we are unable to cancel free of charge or rebook at short notice.

Additional costs / damage

The accommodation must be handed over in perfect condition upon departure. The guest must ensure that all items, the accommodation itself and all products provided by the guesthouse are left in perfect condition. This applies in particular to furnishings (furniture, mirrors, TV, etc.), the apartment/room itself (floors, walls, tiles, lamps, etc.) and all items used that are the responsibility of the guesthouse. All items provided by the guesthouse (e.g. electrical appliances, hand and bath towels, etc.) are also covered by this clause.

If, in addition to the standard services offered and provided by the guesthouse, additional expenses are incurred which are caused by the guest (e.g. increased cleaning performance due to increased soiling, inappropriate use of materials such as towels, toilet paper, etc.), these will be charged to the guest. The calculation basis for these services/materials are both the price lists of the suppliers (such as bed linen/towels) and the comparison to the conventionally provided service. In the case of extreme dirt such as faeces, etc., the guesthouse reserves the right to hire a cleaning company and to charge for this in full.

Termination by the pension

The pension is entitled to terminate accommodation contracts with immediate effect and to expel the guest from the house in the exercise of his house rights if the guest damages the reputation, security or reputation of the pension, is suspected of committing criminal offenses or other guests, residents harasses, repeatedly disturbs or endangers passers-by or neighbors.

In particular, repeated violations by the guest of the provisions of these terms and conditions or the house rules posted in the house, as well as damage, soiling or theft of property entitle the guesthouse to terminate the contract immediately. This also applies if the guest uses the room or other rooms in the guesthouse for a purpose other than the agreed purpose.

In these cases, the guest may be obliged to pay damages and to pay for the accommodation already used, as well as to pay for the accommodation not yet used in accordance with the cancellation regulations.

Care
  1. The accommodation may only be occupied by the number of people specified in the contract. Deviations from this require a prior written agreement with the pension. The specified maximum number of people also includes children. In the event of overcrowding, the guesthouse is entitled to demand additional reasonable compensation for the period of overcrowding. The excess persons must leave the accommodation immediately.
  2. The erection of tents, caravans or similar on the property is not permitted.
  3. The pension is not liable for the loss of or damage to items brought in, including cars and bicycles. Bringing your own property into the accommodation, including parking your car in the parking lot and your bicycle, is at your own risk.
  4. The guest further undertakes to do everything reasonable in the event of any disruptions to service in order to contribute to remedying the disruption and to keep any damage as low as possible.
  5. Claims and complaints about services not received in accordance with the contract must be reported to the guesthouse immediately, even during his stay.
  6. A pet can only be brought by prior arrangement with the guest house. This must be indicated in the reservation. The guest bringing the pet is solely liable for any damage caused by the pets brought in.
Place of jurisdiction

The place of jurisdiction is exclusively the District Court of Stendal

Final Provisions

German law applies. Should individual provisions of these General Terms and Conditions for the conclusion of accommodation contracts be ineffective, this does not affect the validity of the remaining provisions. Instead of the invalid provision, one of the closest legal provisions applies. Any deviation or ancillary agreement must be in writing.
